terms of use
The only
restrictions on the use of my materials/sites/domains are as follows:
1. You
must not engage in any libellous, abusive, pornographic, 'adult' or potentially
actionable (under the law) advertising campaigns or promotional work which
links to my sites or claims I endorse, fund, advocate or that I am otherwise involved
in it in any way at all of any kind.
2. If
you are doing any kind of mass email promotional work, you must not direct your
opt-in customers straight to my products, sites or domains from your emails.
Why? Spam - that's why.
Now, I am not saying that everybody who sends emails to large lists of people
is engaged in spamming... However, unfortunately, some people who may have opted-in
to your email list may (for whatever reason) decide that the emails they have
just received from you are spam and report them (and you or I) as such.
As I have no control
over the emails you send or how people will react to them, I must ask you not
to direct people straight to my sites, product pages or domains via email.
So that we are all clear
about what constitutes spam, here is the definition: sending just one email to
somebody who has not opted-in to your list (i.e. actively asked to receive or
agreed to receive one or more emails from you) is spamming. Please do not do it.
Also, be aware: there are
many vendors now selling 'safe lists'... there is no such thing as a 'safe' list
unless you have built it yourself. Do not be fooled by these 'email millions of
people' promotions. For all you and I know they could just have 'trawled' their
lists off the Internet and the people on those lists will not have agreed to receive
emails from them (and therefore from you). They may simply take your money and
disappear into thin air, leaving you alone to face the fallout, when the brown
stuff hits the fan.
Just one spam complaint
can get you shut down. Build your own list and email to that instead...
To
send people to my sites/domains/products via email, use a robust and reliable
redirect system* such as the Implix
HyperTracker.*
*Please
note that you are free to use whatever redirect service or system you like and
that you do not have to use HyperTracker - HyperTracker is simply a good example
of how it can and should be done...
The links in your emails
will then point to e.g. HyperTracker's
system, and not directly to my sites/domains etc.
HyperTracker,
for example, will enable you to track how many times each link was clicked on
(many online marketers state that this is essential for affiliate promotional
work) and then automatically redirect anybody who clicks on a link to my site.
When your opt-in email customer clicks on the link, all they will see is my site
load up in a few seconds as usual!
Using such a system
you can track your customers' clicks and link to all your affiliates indirectly.
It is easy to do, cost effective and safer for everybody concerned... including
you.
This protects everybody's
sites/domains/products and also provides you with the means to assess how effective
your emails are in generating the all important 'click through'. Please browse
the HyperTracker
site via any one of the above three links to see and understand how it works,
but feel free to select an alternative system/vendor...
...If you don't want to
use HyperTracker
then that is fine with me. You are free to use whatever system or service you
like... just don't link directly to my sites/domains/products etc. from your emails.

3. You
must also not claim that I have endorsed you in your mass emailing activities
in any way. This way, if you generate any spam complaints, they will be directed
at you and not me.
If
I receive a spam complaint against my sites/domains etc., because of something
anybody except me has done, I will have to act accordingly to protect my investments
and interests.
Spam
is a *hot* issue - and getting hotter by the day - please do take it very seriously
and do be careful how you use email.
4. You
agree that the use of my text, copy, links, scripts and other materials does not
grant or imply any formal association with my domains/sites/products/businesses
etc. and you also agree that you do not and will not acquire, gain or have any
rights whatsoever to or on my products/sites/logos/ graphics/domains/businesses
etc. either now or in the future.
5. You
agree only to represent my sites/domains/products etc. in a positive, professional
and accurate manner.
